An elderly Florida man wants to take a big bite out of Waffle House’s profits — through a lawsuit saying that one of the chain’s ads caused him to be distracted and fall down, causing serious injuries.
Edward Bowlds says the Barstow, Florida location of the chain was responsible for his pain and suffering because it erected an overly large poster advertising Strawberry Shortcake Waffles — an image that “increased the risk of harm beyond ordinary conditions by prioritizing marketing and visual appeal over pedestrian safety.” Bowlds’ suit also claimed that there was no need for the ad in the first place, since it was located in a place where it could only be seen by people already on site and ready to chow down.
According to court papers, the 84-year-old tore his rotator cuff and “will deal with pain and limitations the rest of his life.” Bowlds and his wife, who is his co-plaintiff in the suit, would have accepted a settlement of $300,000, but when Waffle House declined the offer, the pair filed suit.
